1. Acceptance of Terms

By accessing and using StoryNight (storynight.co), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to make changes to these terms at any time. Your continued use of StoryNight following the posting of revised Terms of Service means that you accept and agree to the changes.

2. Description of Service

StoryNight is an entertainment platform designed to provide users with interactive storytelling experiences, narrative content, and related digital services. The platform offers curated stories, user-generated content options, and community features accessible to registered subscribers. The service is provided on an as-is basis and may include premium features, exclusive content, and interactive elements. StoryNight reserves the right to modify, suspend, or discontinue any service or feature at any time, with or without notice.

3. User Accounts

3.1 Account Creation

To access StoryNight, you must create an account by providing accurate, current, and complete information as requested during the registration process. You are responsible for maintaining the confidentiality of your account information, including your password. You agree to accept responsibility for all activities that occur under your account. You agree to notify StoryNight immediately of any unauthorized use of your account or any other breach of security.

3.2 Account Eligibility

You must be at least 18 years of age to create and maintain an account on StoryNight. By registering, you represent and warrant that you are at least 18 years of age and that all information you provide is truthful and accurate.

3.3 Account Suspension or Termination

StoryNight reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms of Service, fraudulent activity, abuse of the platform, or any behavior determined by StoryNight to be harmful to other users or the integrity of the service.

4. Payment Terms

4.1 Subscription Fee

StoryNight offers a subscription service at the rate of twelve dollars ($12.00) per month. This subscription provides access to the full range of features, content, and services available on the platform. Billing occurs automatically each month on the anniversary of your subscription start date. You authorize StoryNight to charge your selected payment method for all subscription fees and other applicable charges in accordance with these terms.

4.2 Payment Method

You agree to provide accurate and complete payment information. Accepted payment methods include major credit cards, debit cards, and other payment options as specified on the platform. You are responsible for keeping your payment information current and valid. StoryNight uses secure payment processing; however, you acknowledge that online transactions carry inherent risks.

4.3 Billing and Invoices

Subscription charges are billed monthly in advance. You will receive a confirmation email prior to each billing cycle. Billing inquiries should be directed to the contact information provided in Section 10 of these Terms of Service.

4.4 Cancellation Policy

You may cancel your StoryNight subscription at any time. Cancellation can be processed through your account settings under the subscription management section, or by contacting our support team at the email address provided in Section 10. Cancellation will take effect at the end of your current billing cycle. You will retain access to StoryNight until the end of your paid subscription period. No refunds will be issued for the unused portion of your current billing cycle if you cancel prior to the next billing date. If you cancel and later decide to reactivate your account, you will be charged the then-current subscription rate.

4.5 Refund Policy

StoryNight offers a limited refund policy. If you are not satisfied with the service, you may request a refund within fourteen (14) days of your initial purchase or subscription activation, provided that your account usage during this period has been minimal. Refunds will be issued to the original payment method used for the transaction. Refund requests must be submitted in writing to the contact information provided in Section 10.

The following conditions apply to refund eligibility:

Refunds do not apply to subsequent billing cycles. Once a refund is issued, your account access will be terminated. Refund processing may take five to ten (5-10) business days. Promotional or discounted subscription offers may have their own refund terms, which will be clearly stated at the time of purchase.

4.6 Price Changes

StoryNight reserves the right to change subscription fees at any time. Changes to the subscription price will take effect at the beginning of the next billing cycle following notice to you. Your continued use of the service following a price increase constitutes your acceptance of the new rate. If you do not agree to the price change, you may cancel your subscription before the new rate takes effect.

5. Intellectual Property Rights

5.1 StoryNight Content

All content, materials, software, text, graphics, illustrations, logos, images, audio, and video files available on StoryNight, including but not limited to stories, narratives, interactive elements, and design elements, are the property of StoryNight or its content providers and are protected by international copyright and intellectual property laws. Unless expressly stated otherwise, you are granted a limited, non-exclusive, non-transferable license to access and view the content for personal, non-commercial use only. You may not reproduce, redistribute, transmit, modify, adapt, translate, or create derivative works from any content without prior written consent from StoryNight.

5.2 User-Generated Content

If StoryNight provides features that allow you to submit, upload, or contribute content to the platform, you retain ownership of your content, but grant StoryNight a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute your content on the StoryNight platform and in connection with its services. By submitting content, you represent and warrant that you own or have proper authorization to grant such licenses for all submitted material and that the content does not infringe upon any third-party intellectual property rights.

5.3 Prohibited Uses

You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software or technology used on StoryNight. You agree not to use any automated tools, scraping software, bots, or similar mechanisms to access, download, or extract content from the platform without express written permission.

6. Limitation of Liability

6.1 Disclaimer of Warranties

StoryNight is provided on an as-is and as-available basis. To the fullest extent permitted by law, StoryNight disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. StoryNight makes no warranty that the service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

6.2 Limitation of Damages

To the fullest extent permitted by applicable law, in no event shall StoryNight, its officers, directors, employees, agents, or content providers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of or inability to use the service, including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses, even if StoryNight has been advised of the possibility of such damages.

6.3 Cap on Liability

In no event shall StoryNight's total liability to you for all claims arising out of or relating to these Terms of Service or your use of StoryNight exceed the total amount paid by you to StoryNight in the twelve (12) months immediately preceding the claim, or fifty dollars ($50.00), whichever is greater. Some jurisdictions do not allow limitations on liability, so this limitation may not apply to you.

StoryNight may contain links to third-party websites and services. StoryNight is not responsible for the content, accuracy, completeness, or legality of any third-party websites or services. Your use of third-party websites and services is governed by their own terms of service and privacy policies. StoryNight disclaims all liability for any damages or losses resulting from your interaction with third-party websites or services.
